VSGD Careers - General Terms and Conditions of Service

The Service

VSGD Careers provides a platform for advertising jobs on www.VSGD.co and use of this job advertising platform includes services available, including bespoke options and your selection is detailed on your itemised invoice.

A unique benefit of using the VSGD Careers service and platform is free access (non- chargeable) to a private Facebook Group, with an engaged audience ready to engage with your recruitment campaign. It is an active space to share your jobs, posts, live streaming events and with the ability to interact and communicate with the audience. It also offers a place to connect with Vets Stay Go Diversify Careers community group members to ask questions and contribute unique insights into career opportunities and guidance.

Terms and Conditions

• Customers register and create an employer profile online at https://vsgd.co/login-or-create-profile/ (“Registration”)
• Once an employer profile has been created, customers may create a job advert directly from their company profile and make payment by credit card or may request payment against an invoice.
• Should the customer need to raise a Purchase Order, a quote for VSGD Services will be provided and where applicable the customer will provide appropriate documents and contacts as soon as possible to enable VSGD Careers to be registered as an approved supplier or vendor. 
• Payment shall in all circumstances be made no later than 14 days following Registration, failing which VSGD shall be entitled to suspend services pending full payment.
• Although we will offer some posting style guidance, you will own the contents of your post. You also grant us and other users of the VSGD Careers platform rights to use them.
• You are responsible for the contents that you post. This includes ensuring that you have the rights needed for you to post that content and that your post does not infringe or violate the legal rights of another party (by way of example only, intellectual property rights, privacy or defamation).
• You must comply with all applicable laws, regulations, codes, rules or guidance.
• You must comply with Facebook general rules (accessible at www.facebook.com/policies), familiarise yourself with the rules governing participation in a Facebook group and take full responsibility for the posts you make. 
• You agree to abide by the Vets: Stay, Go or Diversify Privacy Policy and GDPR compliance which can be found here: www.vsgd.co/privacy-policy.
• When using the VSGD Careers group, you must abide by the Group rules, which you will be asked to confirm on your first visit to join the group. These are available at: www.facebook.com/groups/vsgdcareers/about

• When you share, post or upload content to VSGD Careers you grant us a non-exclusive, transferable, sub-licensable, royalty-free and worldwide licence to host, use, distribute, modify, run, copy, publicly perform or display, translate and create derivative works of your content (consistent with your privacy and application settings). This means, for example, that if you post a job advert, you give us and our users the permission to store, copy and share it with others.

• You can repost content from VSGD Careers elsewhere, provided that you attribute the content back to the VSGD Careers platform and respect the rights of the original poster, including any “not for reproduction” designation.
• You shall not do or permit to be done, anything that would or is likely to adversely affect the name, image or reputation of VSGD Careers or and/or its goodwill, brands, business names or trademarks.

• VSGD does not endorse or verify content posted by users. Our content and materials are provided to you “as is” without any guarantees. You are solely responsible for your own use of the VSGD Careers platform. Posts, even from professionally qualified users, should not be treated as a substitute for professional advice for your specific situation.

• As part of using the VSGD Careers services, you must notify VSGD Careers if any VSGD Careers group member accepts an offer of employment with you as a result of the service and a www.VSGD.co job posting. It is your responsibility to ensure this is done in compliance with current data protection regulations.

• VSGD Careers reserves the right to withdraw any content provided by you from its services, platforms, channels or media or otherwise withdraw any of its services for any or no reason at any time by giving you notice in writing.  Such notice of withdrawal shall be given as far in advance as is reasonable in the circumstances, it being understood that in the case of any breach of contract, infringement or non-compliance with applicable laws we reserve the right to immediately withdraw content and/or services (as applicable). Following any such withdrawal, we may (at our sole discretion) either provide replacement services or refund part of the fee on a pro-rata basis.
• If you're a business, then we shall not be liable to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any loss of profit, or any indirect or consequential loss arising under or in connection with any contract between us; and our total liability to you for all other losses arising under or in connection with any contract between us, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall be limited to 50% of the total sums paid by you for services under such contract in the 12 month period immediately preceding the event giving rise to any such liability.
• Notwithstanding the foregoing, nothing in these terms shall limit or exclude our liability for death or personal injury caused by our negligence, or the negligence of our employees, agents or subcontractors (as applicable); fraud or fraudulent misrepresentation; breach of the terms implied by section 12 of the Sale of Goods Act 1979 or section 2 of the Supply of Goods and Services Act 1982.

Cancellations, returns and refunds.

• Unless otherwise: (i) provided during your purchase of services you choose; or (ii) required by applicable law in your jurisdiction, should you become dissatisfied with the service within the first 14 days after purchase, VSGD Careers will refund the full amount of your purchase and subsequently terminate your access. You must notify VSGD Careers that you wish to cancel your order within 14 days after your order is placed or delivered. You do not need to give a reason for cancelling. Notwithstanding the foregoing if the product is a digital download, online course or streaming, you waive any right to cancellation or refund as soon as you download, start the course or stream content. 

In addition to your legal rights, we also provide the following options.

• For VSGD Careers advertising, if you do not immediately proceed with your advertising product, we will also offer a credit note for use within six months of your original purchase or invoice date.
• For online products and courses, we will also offer an exchange of an equivalent price, to be used within six months of your original purchase or invoice date.
• For Personal Coaching, Strategy and Resume/CV review, should you start your coaching programme and not use the complete allocation of coaching sessions, we will offer a pro-rated refund on the unused sessions, less a 25% administration fee. This applies within 9 months from your original purchase or invoice date. 
• We will endeavour to accommodate any requests to cancel or rearrange coaching sessions however this may not always be possible. If less than 48 hours’ notice is given, you may be charged for the session and if you fail to attend, then the session will be forfeit. 

How to notify Stay Go Diversify Ltd that you wish to make a cancellation, exchange and refund.

• To claim a refund, exchange, credit note, cancellation or rescheduling of sessions, you must notify within 14 days of the relevant purchase by emailing [email protected] and your sales/account manager if applicable.
